Schools should offer a safe and secure environment for all young people to develop, to learn, and to thrive. Sadly, for many, they fall short. Homophobic and transphobic behaviour is still painfully common in schools across Europe. A significant number of LGBT pupils experience homophobic and transphobic bullying, and they are more likely to experience violence than heterosexual peers. This publication explores the underlying attitudes towards homosexuality in eight European countries: Belgium, Germany, Hungary, Poland, Spain, the Netherlands, the United Kingdom and Turkey. It is the product of a strategic partnership (KA2) between fifteen European secondary and higher education institutions, launched in 2016 under the auspices of the European Commisson's ERASMUS+ programme. The project supported by this partnership, Homo'poly, promotes greater understanding and acceptance of homosexuality with the explicit aim of improving the school life of LGB pupils. This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this ‘new order of the ages’ suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically ‘higher’ form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments – from the French Revolution to Napoleon’s downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first – Emmanuel Joseph Sieyès’ Du Jury Constitutionnaire (1795) – highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second – the 1812 draft of the Constitution of the Kingdom of Poland – presents the ‘constitutional propaganda’ of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe’s constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. "The Wadden Sea Region is comprised of the embanked coastal marshes and islands in the Wadden Sea near Denmark, Germany, and the Netherlands, and this area retains an exceptional common history in all its aspects: archaeologically, economically, socially, and culturally. Its settlement history of more than two thousand years is unrivalled and still mirrored in the landscape and even though it has never constituted a political unity, it still shares a landscape and cultural heritage. For example, the approaches to water management and associated societal organisation developed in the region during the last millennium have set significant world standards, values which were recognised by UNESCO in inscribing the Wadden Sea on its World Heritage List. Why do early films present the Netherlands as a country full of canals and windmills, where people wear traditional costumes and wooden shoes, while industries and modern urban life are all but absent? Where do such visual clichés come from? This study investigates the roots of this imagery in popular visual media ranging from magazines to tourist brochures, from anthropological treatises to advertising trade cards, stereoscopic photographs, picture postcards, magic lantern slide sets and films of early cinema. The book provides an in-depth study of this rich and fascinating corpus of popular visual media that has not been studied before, and the discourses that these images were meant to illustrate. This intermedial approach offers new insights into the emergence of national clichés and the study of stereotypical thinking.

Governments have known since the 1960s that smoking results in irreversible health damage. This open access book examines why governments have done so little to combat this when they have been aware of the problem and its solutions for decades. What are the strategies and decisions that make a difference, given that policy environments are often not conducive to change? Taking the Netherlands as an example, this book helps to understand the complex policy process at the national level and why it so often appears irrational to us. It is the most sophisticated analysis of tobacco control policy to date, applying insights from political sciences to the field of tobacco control. Marc C. Willemsen is Professor of Tobacco Control Research at the Department of Health Promotion, University of Maastricht, the Netherlands. He started tobacco research in 1989 and has since become a recognised expert in the field of tobacco control. He wrote and contributed to numerous research studies and scientific papers. In addition to his academic work, he gained first hand insights into the policy making process while working for various national tobacco control organisations. .
